Divorce

Filling for divorce is never an easy decision. It is an emotionally draining experience. Unfortunately, the process is often long and involves many procedural steps to properly and efficiently finalize the divorce. The Montes Law Firm can guide you through the procedure so that you can concentrate on your emotional well-being.

Types of Divorce

  • Uncontested

The easiest and least complicated divorce is an uncontested divorce. When the two parties can agree on all of the issues, it is truly an uncontested divorce. If there is community property, both parties must agree on how to divide the property. If there are children, then the parties must agree on all issues concerning the children.

  • Contested Without Minor Children

The only real issue in these types of divorces is the division of property. An attorney will review the couple's assets and classify them to determine the value of the community estate. Most courts will require the couple to attempt to agree. If an agreement is not reached, then it is up usually up to the judge to make a fair and equitable division of the community estate.

  • Contested With Minor Children

When children were born during the marriage, even if the child's father is not the same as the husband, the divorce must also dispose of any issues dealing with the children. The more parties are involved the more complex the case becomes.

Child custody

Child Custody issues are the most sensitive in family law. You must hire an attorney to help you through the court proceedings.

Frequently Asked Questions

  • Who has the right to the children?

Neither parent has a greater right to a child whether it is a mother or a father. When there is a dispute, it is important to petition a family court to issue an order establishing the rights and duties of each party.

  • How much child support will I have to pay?

Texas uses a formula to determine how much a person has to pay. It is determined in accordance with chapter 154 of the Texas Family Code. It is not an arbitrary number based on the opinion of either party.
